1. Agreement to Terms

By accessing or using CapturedInLife ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

These Terms constitute a legally binding agreement between you and CapturedInLife regarding your use of the Service. Please read them carefully.

2. Description of Service

CapturedInLife is an AI-powered photo gallery platform that allows users to upload, organize, and share photos. Our services include:

• Photo upload and storage
• AI-powered face recognition and keyword tagging
• Gallery creation and sharing
• Search functionality within galleries
• Subscription-based premium features

3. Account Registration

3.1 Eligibility

To use our Service, you must:

• Be at least 13 years of age
• Have the legal capacity to enter into a binding contract
• Provide accurate and complete registration information
• Maintain the security of your account credentials

3.2 Account Responsibilities

You are responsible for:

• All activities that occur under your account
• Maintaining the confidentiality of your password
• Notifying us immediately of any unauthorized use
• Ensuring your account information is current and accurate

4. Subscription and Payments

4.1 Plans and Pricing

We offer the following subscription plans:

• Free: Limited features at no cost
• Individual: One-time payment per gallery
• Business: Monthly subscription with unlimited galleries

4.2 Payment Terms

• Payments are processed securely through Stripe
• Subscription fees are charged in advance on a monthly basis
• All fees are non-refundable unless required by law
• We reserve the right to change pricing with 30 days notice

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will continue to have access until the end of the period for which you have paid.

5. User Content

5.1 Ownership

You retain all ownership rights to the photos and content you upload ("User Content"). By uploading content, you grant us a limited license to use, store, and process your content solely to provide and improve our services.

5.2 Content Restrictions

You agree not to upload content that:

• Infringes on intellectual property rights of others
• Contains illegal, harmful, or offensive material
• Violates privacy rights of individuals depicted
• Contains malware, viruses, or malicious code
• Promotes illegal activities or violence
• Is sexually explicit or pornographic

5.3 Content Removal

We reserve the right to remove any content that violates these Terms or that we determine to be inappropriate, at our sole discretion. Repeat violations may result in account termination.

6. Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Scrape, crawl, or spider any part of the Service
• Impersonate another person or entity
• Harvest or collect email addresses or other contact information
• Bypass any measures we may use to prevent access
• Use the Service to send unsolicited communications
• Reverse engineer or attempt to extract source code
• Exceed reasonable usage limits or abuse the Service

7. Intellectual Property

7.1 Our Rights

The Service and its original content, features, and functionality are owned by CapturedInLife and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or business purposes, subject to these Terms.

7.3 Trademarks

The CapturedInLife name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of CapturedInLife. You may not use such marks without our prior written permission.

8. AI Features and Face Recognition

8.1 AI Processing

Our Service uses artificial intelligence to analyze photos for face detection and object recognition. By using these features, you acknowledge that:

• AI analysis is automated and may not be 100% accurate
• Face data is processed to enable search functionality within your galleries
• You have obtained consent from individuals depicted in photos where required by law

8.2 Data Processing

Face recognition data is processed using AWS Rekognition. We do not share face data with third parties for their own purposes. Face data is used solely to provide search functionality within your account.

9. Termination

9.1 By You

You may terminate your account at any time by following the instructions in your account settings. Upon termination, your right to use the Service will immediately cease.

9.2 By Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms.

9.3 Effect of Termination

Upon termination, all licenses granted to you will immediately terminate. We may retain certain data as required by law or for legitimate business purposes.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, timely, secure, or error-free
• The results from using the Service will be accurate or reliable
• Any errors in the Service will be corrected
• The Service is free of viruses or other harmful components

11. Limitation of Liability

IN NO EVENT SHALL CAPTUREDINLIFE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us for the Service during the 12 months preceding the claim, or $100, whichever is greater.

12. Indemnification

You agree to defend, indemnify, and hold harmless CapturedInLife and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from your use of the Service or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.
